Introduction
These Terms of Use (“Terms”) govern your use of the rend mobile application (“App”) and associated website (“Website”), collectively referred to as the “Service.”
The Service is provided by Kyler Menge (“we,” “us,” or “our”).
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About the Service
rend is a workout logging application intended to help users record and review their training activity.
The current version allows users to create and manage workouts and exercises, record sets and workout sessions, review previous performance and workout history, archive supported records, and generate Workout Cards.
rend is a recordkeeping tool. It does not provide personalized training programs, professional coaching, medical diagnosis, or medical treatment.
The Service may change over time as features are improved, added, or discontinued.
2. Eligibility
You must be legally permitted to use the Service.
If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian where required by applicable law.
The Service is not intended for children under 13.
3. License to use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, lawful purposes on devices you own or control, as permitted by the applicable app marketplace rules.
This license does not transfer ownership of the App or its intellectual property.
You may not, except where expressly permitted by law:
- Copy, distribute, sell, sublicense, or commercially exploit the App or its software.
- Reverse engineer, decompile, or attempt to extract the App’s source code.
- Circumvent security protections or interfere with the App’s operation.
- Use the Service in violation of applicable law.
- Misrepresent your affiliation with rend or its operator.
4. Your workout information
You are responsible for the information you enter into the App, including workout names, exercise details, sets, and performance records.
You retain any rights you hold in original information or content you create.
rend does not claim ownership of your workout records.
The App processes your entries locally as necessary to provide workout logging, history, and related features.
You are responsible for reviewing your records and correcting inaccurate entries.
5. Local storage and data loss
The current version stores workout records locally on your device.
rend does not currently offer user accounts, operator-managed cloud synchronization, or guaranteed remote backup and recovery.
You are responsible for maintaining your device and any device-level backup arrangements you choose to use.
Workout information may become unavailable due to device loss, hardware failure, operating system changes, application removal, accidental deletion, data corruption, or software defects.
We design the App with safeguards intended to protect data integrity, but we cannot guarantee that all records will remain available or recoverable under every circumstance.
Archiving a record is not equivalent to creating an independent backup.
Deleting a record or uninstalling the App may result in permanent loss of locally stored information.
6. Fitness and health disclaimer
rend is a workout logging tool, not a medical service or professional fitness coaching service.
The App does not evaluate whether a workout, exercise, weight, repetition target, or training routine is safe or appropriate for you.
You are responsible for selecting and performing your own exercises and determining whether a particular activity is suitable for your health, fitness level, and circumstances.
Physical exercise carries inherent risks, including injury.
Seek advice from a qualified healthcare professional before beginning or changing an exercise program when appropriate, particularly if you have an injury, medical condition, or other health concern.
Do not use information displayed in the App as a substitute for professional medical advice.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
7. Workout Cards
The App may allow you to generate and save images representing your workout information.
You are responsible for reviewing the content of a Workout Card before saving, publishing, or sharing it.
Once an image is saved to your device or shared through another application, it may be subject to that device’s or service’s storage, privacy, and sharing practices.
We are not responsible for how third parties use content that you independently choose to share, except where responsibility cannot lawfully be excluded.
8. Availability and updates
We aim to maintain a reliable and functional Service but do not guarantee uninterrupted or error-free operation.
Availability and functionality may be affected by device compatibility, operating system updates, software defects, or circumstances outside our reasonable control.
We may release updates to improve functionality, compatibility, security, or performance.
We may also modify or discontinue features or support for particular devices or operating system versions, subject to applicable law.
9. Intellectual property
The rend name, logomark, branding, software, interface designs, graphics, and other original materials are owned by or licensed to the Service operator and are protected by applicable intellectual property laws.
You may not use these materials in a manner that implies sponsorship, endorsement, or affiliation without prior authorization.
The rights granted to you are limited to those expressly stated in these Terms.
Third-party software components remain subject to their applicable licenses.
10. Fees and future features
The current version of rend does not require a subscription or include in-app purchases.
If paid features, subscriptions, or additional services are introduced in the future, applicable pricing and terms will be disclosed before purchase.
Any future transactions through an app marketplace may also be governed by that marketplace’s terms and policies.
These Terms do not authorize any automatic charges or subscriptions.
11. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.”
We make no guarantee that the Service will be uninterrupted, error-free, completely secure, or free from data loss. To the extent permitted by applicable law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not permit certain warranty exclusions. These exclusions apply only to the extent permitted by applicable law and do not limit rights that cannot legally be excluded.
12. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to use of the Service, including loss of data, loss of profits, or interruption of use.
To the extent permitted by applicable law, our aggregate liability for claims arising from or relating to the Service will not exceed the greater of (a) the amount you paid us for the Service during the 12 months preceding the event giving rise to the claim or (b) US$100.
These limitations apply regardless of the legal theory asserted, to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, personal injury, or any other liability that cannot lawfully be excluded or limited.
13. Ending your use of the Service
You may stop using the Service at any time by uninstalling the App.
Because the current version does not require an account, there is no rend account to close.
We may discontinue distribution or support for the Service, subject to applicable law.
Stopping use of the Service does not automatically remove information retained in device backups or Workout Cards saved outside the App.
Provisions concerning intellectual property, disclaimers, limitations of liability, and other provisions intended to survive will remain effective where applicable.
14. Third-party platforms
The App may be distributed through third-party application marketplaces, including the Apple App Store and Google Play.
Your use of those platforms may be subject to their own terms and policies.
For an App obtained through Apple’s App Store:
- These Terms are between you and the Service operator, not Apple.
- The Service operator, not Apple, is responsible for the App and its content.
- Apple has no obligation to provide maintenance or support for the App.
- To the extent required by applicable law, Apple may have obligations concerning refunds for an App that fails to conform to an applicable warranty.
- The Service operator is responsible for addressing claims relating to the App, including applicable product liability, legal compliance, consumer protection, and intellectual property claims, except as otherwise required by law.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them as applicable.
You must also comply with applicable third-party terms when using the Service.
15. Governing law and disputes
These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law rules, except where mandatory consumer protection laws require otherwise.
Subject to applicable law, disputes arising from these Terms or the Service will be brought before a court of competent jurisdiction in Washington.
Nothing in this section limits rights or remedies that cannot lawfully be waived.
16. Severability
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
17. Entire agreement
These Terms, together with the Privacy Policy and any additional terms expressly presented for specific features, constitute the agreement governing your use of the Service.
Our failure to enforce a provision does not constitute a waiver of our right to enforce it later.
18. Changes to these Terms
We may update these Terms to reflect changes in the Service, applicable law, or our operations.
Updated Terms will be made available through the App or Website and will include a revised effective date.
Where required by law, we will provide additional notice or request acceptance of material changes.
Your continued use of the Service after revised Terms take effect constitutes acceptance to the extent permitted by applicable law.
